2. Platform Description and Services
2.1 What VidyaVriti Provides
VidyaVriti is a digital exam preparation platform that complements physical exam center simulations. We provide:
- Practice Test Engine: Self-paced practice tests covering various competitive exam categories (JEE, NEET, UPSC, CAT, etc.) with timed test execution, full-screen interface, and question navigation
- Result Ingestion: Integration with partner physical exam centers to import your simulation test results into your digital profile
- AI-Powered Feedback: Personalized study recommendations, detailed explanations for incorrect answers, and performance analytics generated using artificial intelligence and machine learning algorithms
- Performance Tracking: Historical test data, score trends, section-wise analysis, topic-wise accuracy tracking, and weak area identification
- Scorecards and Reports: Instant score display, downloadable PDF scorecards, and comprehensive answer key review
- Test Integrity Features: Tab-Switch Guard alerts to encourage focus during timed practice tests
- Question Bank: Curated question library covering exam-specific topics, chapters, and difficulty levels
2.2 What VidyaVriti Does NOT Provide
VidyaVriti is NOT:
- An official examination platform for government or institutional entrance exams
- A substitute for formal education or classroom instruction
- A learning management system (LMS) with video lectures or structured courses
- A live tutoring or one-on-one instruction service
- A guarantee of exam success or admission to any institution
- Affiliated with, endorsed by, or representing any official examination authority (JEE, NEET, UPSC, CAT, etc.)
2.3 Platform Availability
- Service Availability: We strive to provide uninterrupted access to VidyaVriti 24/7/365, but we do not guarantee that the Platform will always be available or error-free.
- Scheduled Maintenance: We may perform scheduled maintenance, which will be announced in advance where possible.
- Emergency Downtime: Unexpected outages may occur due to technical issues, security incidents, or circumstances beyond our control.
- No Liability for Downtime: We are not liable for any interruption of service, loss of data during transmission, or inability to access the Platform.
2.4 Changes to Services
We reserve the right to:
- Modify, suspend, or discontinue any feature or functionality of the Platform
- Change pricing structures, service tiers, or subscription models
- Add or remove question content, test categories, or exam types
- Update AI algorithms and feedback mechanisms
Material changes to paid services will be communicated in advance where commercially reasonable.
3. Account Registration and Security
3.1 Account Creation
To access VidyaVriti Services, you must create an account by providing:

- Valid email address
- Phone number (for OTP verification)
- Password (meeting minimum security requirements)
- Exam category and target year
- Date of birth (to verify age eligibility)
- Optional: City, state, gender, academic status
3.2 Account Verification
- Email Verification: You must verify your email address by clicking the verification link sent during registration.
- Phone OTP Verification: You must verify your phone number using the one-time password (OTP) sent via SMS.
- Parental Consent Verification (for users under 18):
Parents/guardians must complete identity verification using government-issued ID and provide explicit consent via our secure portal.
Your account will be activated only after successful verification.
3.3 Account Accuracy and Updates
You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and current
- Notify us immediately of any unauthorized use of your account or security breach
3.4 Account Security Responsibilities
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account, whether authorized or unauthorized
- Any consequences of unauthorized access resulting from your failure to maintain account security
You agree to:
- Use a strong, unique password and change it periodically
- Not share your account credentials with any third party
- Log out of your account after each session, especially on shared devices

3.5 One Account Per User

- Respect the rights of other users and VidyaVriti staff
- Provide honest and accurate information

4.2 Prohibited Activities
You agree NOT to:
- Violate Laws: Engage in any activity that violates Indian law or the laws of your jurisdiction
- Impersonate: Impersonate any person or entity, or falsely represent your affiliation with any person or organization
- Unauthorized Access: Attempt to gain unauthorized access to any portion of the Platform, other users' accounts, or computer systems/networks
- Interfere with Operations: Disrupt, interfere with, or create undue burden on the Platform's infrastructure or networks
- Circumvent Security: Bypass, disable, or circumvent any security features, access controls, or usage limitations
- Reverse Engineer: Decompile, reverse engineer, disassemble, or attempt to derive source code from the Platform
- Automated Access: Use bots, scripts, scrapers, or automated tools to access the Platform without explicit written permission
- Content Scraping: Extract, copy, or download question banks, test content, or proprietary materials
- Cheating/Fraud: Engage in cheating, answer sharing, fraudulent test-taking, or any activity that compromises test integrity
- Multiple Accounts for Cheating: Create multiple accounts to retake tests, circumvent limitations, or manipulate results
- Malicious Code: Upload, transmit, or distribute viruses, malware, trojans, or any harmful code
- Spam/Harassment: Send unsolicited communications, spam, or engage in harassment of other users or staff
- Offensive Content: Upload or transmit defamatory, obscene, abusive, hateful, or otherwise objectionable content
- Intellectual Property Infringement: Infringe on VidyaVriti's or any third party's intellectual property rights
- Commercial Use: Use the Platform for commercial purposes without express written authorization
- Share Account: Share your account credentials with others or allow unauthorized use of your account
4.3 Test Integrity and Academic Honesty
VidyaVriti promotes academic integrity. During practice tests, you agree to:
- Take tests independently without external assistance
- Not use unauthorized reference materials, calculators (unless permitted), or communication devices
- Not share or discuss test questions or answers with others
- Not engage in any form of cheating or academic dishonesty
Tab-Switch Guard: Our platform monitors navigation away from the test window during timed tests. Excessive tab-switching may result in warnings or test invalidation.
4.4 Consequences of Violations
Violation of these Terms, including prohibited activities, may result in:
- Warning notices
- Temporary suspension of account access
- Permanent termination of account
- Deletion of test scores and results
- Legal action and referral to law enforcement (for serious violations)
- Liability for damages caused by your misconduct
We reserve the right to investigate violations and take appropriate action at our sole discretion.
5. Content Ownership and Intellectual Property
5.1 VidyaVriti Intellectual Property
All content and materials available on the Platform are owned by or licensed to VidyaVriti and are protected by:

"VidyaVriti Content" includes:

- Text, graphics, images, videos, audio

5.2 Limited License to Users
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Access and use the Platform for your personal, non-commercial educational purposes
- View and interact with VidyaVriti Content during your authorized use
- Download scorecards and performance reports for personal reference
This license does NOT permit you to:

- Create or distribute "question banks" derived from our Content
- Use our Content to create competing exam preparation services
Violations may result in immediate account termination and legal action.
5.4 User-Generated Content
If you provide feedback, suggestions, comments, or ideas to VidyaVriti ("User Feedback"):
- You grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and incorporate such feedback into our Services

- We have no obligation to compensate you for feedback

VidyaVriti collaborates with physical exam centers to provide integrated practice and feedback experiences. When you appear for a simulation test at a partner center:
- The exam center collects your response data during the physical simulation
- The center transfers your data to VidyaVriti for result processing and feedback generation
- Data is matched to your VidyaVriti account using roll number or registered email
6.2 Independent Fiduciaries
Partner exam centers are independent entities and act as separate Data Fiduciaries under the Digital Personal Data Protection Act, 2023. They are responsible for:
- Obtaining your consent for data collection during physical simulations
- Compliance with data protection laws for data collected at their centers
- Secure transfer of data to VidyaVriti
VidyaVriti is not responsible for data practices at partner centers before data transfer.
6.3 Data Accuracy and Disputes
VidyaVriti processes data received from partner centers "as is." We are not responsible for:
- Errors or inaccuracies in data provided by exam centers
- Disputes regarding test administration at physical centers
- Technical issues during physical simulations
- Scoring discrepancies originating from center data
For issues regarding physical exam simulations, contact the partner center directly.
6.4 Result Processing Timeline
After receiving data from partner centers:
- Results are typically processed and available within 24-48 hours
- Processing time may vary based on data volume and complexity
- You will be notified when results are available via email and platform notification
6.5 No Guarantee of Partner Data
We do not guarantee that:
- All partner centers will provide data for all students
- Data transfer will occur immediately after physical simulations
- Data will be error-free or complete
If you do not receive expected results within 7 days, please contact our support team.
7. AI-Powered Features and Automated Decisions
7.1 Use of Artificial Intelligence
VidyaVriti uses artificial intelligence (AI), machine learning (ML), and large language models (LLMs) to enhance educational outcomes. Our AI systems:
- Analyze your test performance patterns and identify weak areas
- Generate personalized study recommendations and topic prioritization
- Provide detailed explanations for incorrect answers
- Predict exam readiness and performance trends
- Flag potential test integrity issues (Tab-Switch Guard)
7.2 Nature of AI Recommendations
AI-generated recommendations are educational suggestions, not guarantees:
- Predictions about exam readiness are estimates based on performance data
- Weak area identification may not capture all individual learning needs
- Explanations are generated automatically and may occasionally contain errors
- Study recommendations should be considered alongside your own judgment and other resources
VidyaVriti does not guarantee:
- That following AI recommendations will result in exam success
- The accuracy of all AI-generated explanations
- That AI predictions perfectly reflect your actual capabilities
7.3 Your Rights Regarding AI
Under DPDP Act and these Terms, you have the right to:
- Explanation: Request an explanation of how an AI decision was made
- Human Review: Request human review of AI-flagged incidents (e.g., Tab-Switch warnings, test integrity alerts)
- Challenge: Challenge any AI decision and request manual review by our academic team
- Opt-Out: Request to disable certain AI features (may limit functionality)
To exercise these rights: Contact our Grievance Redressal Officer with your user ID, the specific AI decision in question, test ID and date (if applicable), and reason for review.
Response timeline: 7 business days for human review.
7.4 No High-Risk AI Decisions
VidyaVriti does NOT use AI for:
- Creditworthiness or loan decisions
- Employment or hiring decisions
- Legal determinations or advice
- Medical diagnosis or health decisions
- High-risk automated profiling
Our AI is used exclusively for educational feedback and performance analytics.
7.5 AI Training and Data Use
Your test response data may be used (in aggregated and anonymized form) to:
- Train and improve AI recommendation algorithms

9. Warranties and Disclaimers

THE VIDYAVRITI PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY INDIAN LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability

- Non-infringement

- That all features will function perfectly at all times
Educational outcomes depend on many factors beyond our control, including your effort, aptitude, preparation quality, and exam conditions.
9.3 Content Accuracy Disclaimer

- Answer keys may occasionally be incorrect
- AI-generated explanations may contain inaccuracies

We encourage users to:

VidyaVriti does not provide:
- Legal, medical, financial, or professional advice
- Official career counseling or admission guidance
- Guarantees about exam eligibility or qualification
Any information provided is for general educational purposes only and should not be relied upon as professional advice.
9.7 Limitation on Implied Warranties
Some jurisdictions do not allow the exclusion of implied warranties. In such cases, the above disclaimers may not apply in full, and implied warranties are limited to the shortest duration permitted by law.
10. Limitation of Liability
10.1 Scope of Limitation
TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW, VIDYAVRITI, KALQORE VENTURES, AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:
- Indirect Damages: Indirect, incidental, special, consequential, exemplary, or punitive damages
- Financial Losses: Loss of profits, revenue, business, contracts, anticipated savings, or business opportunities
- Data Loss: Loss of data, test scores, performance history, or user content
- Reputational Harm: Damage to reputation or goodwill
- Educational Outcomes: Exam failure, poor performance, missed admission opportunities, or career setbacks
- Third-Party Actions: Actions or omissions of partner exam centers, payment gateways, or other third parties
- Technical Failures: Service interruptions, downtime, bugs, errors, or technical malfunctions
- Security Incidents: Unauthorized access to accounts, data breaches, or cyberattacks (subject to our best efforts to prevent)
- User Misconduct: Losses resulting from your violation of these Terms or misuse of the Platform
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.2 Maximum Aggregate Liability
IF, NOTWITHSTANDING THE ABOVE, WE ARE FOUND LIABLE FOR ANY CLAIM, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE LESSER OF:
- The amount you paid to VidyaVriti in the 12 months preceding the claim, OR
- ₹5,000 (Five Thousand Indian Rupees)
10.3 No Liability for Free Services
FOR USERS USING FREE TIER SERVICES (WHO HAVE NOT PAID ANY SUBSCRIPTION FEES), OUR LIABILITY SHALL BE LIMITED TO ₹500 (FIVE HUNDRED INDIAN RUPEES).
10.4 Basis of the Bargain
You acknowledge that:
- These limitations of liability are fundamental elements of the agreement between you and VidyaVriti
- We would not provide the Services without these limitations
- The pricing and availability of Services reflect this allocation of risk
10.5 Exceptions
The above limitations do NOT apply to:
- Liability for death or personal injury caused by our gross negligence
- Liability for fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under applicable Indian law
10.6 Your Remedies
Your sole and exclusive remedy for dissatisfaction with VidyaVriti is to:
- Stop using the Platform
- Request account deletion
- Seek a refund within the refund policy terms (Section 8.8)
11. Indemnification
11.1 Your Indemnity Obligation
You agree to indemnify, defend, and hold harmless VidyaVriti, Kalqore Ventures, and our directors, officers, employees, agents, partners, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
- Your Use of Services: Your access to or use of the VidyaVriti Platform
- Violation of Terms: Your violation of these Terms or our Privacy Policy
- Violation of Law: Your violation of any applicable law, regulation, or third-party right
- User Content: Any content, data, or information you submit, upload, or transmit through the Platform

11.2 Indemnification Process
If we seek indemnification:
- We will provide prompt notice of the claim
- You will assume full control of the defense and settlement (with our approval)
- We reserve the right to participate in the defense at our own expense
- You may not settle any claim that imposes obligations on us without our prior written consent
11.3 Scope of Indemnity
This indemnity obligation:
- Survives termination of your account or these Terms
- Applies even if your account has been deleted
- Extends to all legal fees, court costs, and settlement amounts
12. Termination and Suspension
12.1 Termination by User
You may terminate your use of VidyaVriti at any time by:
- Deleting your account through profile settings
- Contacting our Grievance Redressal Officer
- Ceasing to use the Platform
Account deletion is subject to:
- 48-hour advance notice before permanent deletion
- Data retention requirements as described in our Privacy Policy
- No refunds for remaining subscription periods (except within refund policy window)
12.2 Termination or Suspension by VidyaVriti
We reserve the right to suspend or terminate your account and access to the Platform, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or our Privacy Policy
- Engaging in prohibited activities (Section 4.2)
- Academic dishonesty, cheating, or test integrity violations
- Fraudulent or illegal activity
- Providing false or misleading information
- Creating multiple accounts for abuse or circumvention
- Unauthorized use of intellectual property
- Harassing or abusive behavior toward users or staff
- Security threats or attempts to compromise the Platform
- Non-payment of subscription fees
- Prolonged inactivity (as per Privacy Policy)
- Legal or regulatory requirements
- At our discretion for any other legitimate reason
12.3 Effect of Termination
Upon termination or suspension:
- Your right to access and use the Platform immediately ceases
- Your account, test history, and performance data may be deleted (subject to mandatory retention requirements)
- Active subscriptions are forfeited without refund (unless termination was wrongful)
- You remain liable for any outstanding obligations or liabilities incurred before termination
- Sections of these Terms intended to survive (Intellectual Property, Warranties, Liability, Indemnification, Governing Law) continue to apply
12.4 No Liability for Termination
We are not liable to you or any third party for:
- Termination or suspension of your account
- Deletion of your data (subject to Privacy Policy requirements)
- Loss of access to paid services (except as required by law)
12.5 Appeal Process
If you believe your account was wrongfully terminated:

- Provide evidence supporting your claim
- We will review and respond within 30 days
Final decisions on account termination are at our sole discretion.
13. Force Majeure
13.1 Definition
"Force Majeure Event" means any event or circumstance beyond our reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, storms, natural disasters)
- War, terrorism, civil unrest, riots, or armed conflict
- Government actions, laws, regulations, or orders
- Strikes, labor disputes, or industrial action
- Telecommunications or internet service failures
- Cyberattacks, hacking, or distributed denial-of-service (DDoS) attacks
- Power outages or utility failures
- Epidemics, pandemics, or public health emergencies
- Fire, explosion, or infrastructure damage
- Third-party service provider failures (hosting, payment gateways, SMS services)
13.2 Effect of Force Majeure
We shall not be liable for:
- Any failure to perform or delay in performing our obligations under these Terms
- Service interruptions, downtime, or unavailability
- Loss of data or inability to access the Platform
During a Force Majeure Event, our obligations under these Terms are suspended for the duration of the event.
13.3 Notice and Mitigation
If a Force Majeure Event occurs:
- We will use commercially reasonable efforts to notify affected users
- We will attempt to mitigate the effects and resume Services as soon as practicable
- We may provide alternative access methods or compensation at our discretion (not required)
13.4 Extended Force Majeure
If a Force Majeure Event continues for more than 30 consecutive days, either party may terminate the affected portion of these Terms without liability.

14.2 Jurisdiction

14.5 Class Action Waiver

- You will bring claims against VidyaVriti only in your individual capacity
- You will not participate in or seek to join class actions, collective actions, or representative proceedings
- You waive any right to have disputes resolved on a class, consolidated, or representative basis
14.6 Time Limitation on Claims
You must commence any legal action or arbitration within ONE (1) YEAR from the date the cause of action arose. After this period, claims are permanently barred.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VidyaVriti regarding the Platform and supersede all prior or contemporaneous communications, agreements, or understandings (written or oral).
15.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction:
- That provision shall be modified to the minimum extent necessary to make it enforceable
- If modification is not possible, the provision shall be severed
- All other provisions shall remain in full force and effect
15.3 Waiver
Our failure to enforce any right or provision of these Terms does NOT constitute a waiver of that right or provision.
- Waiver of any term must be in writing and signed by an authorized representative
